A BILL for 1 AN ACT relating to crimes and offenses; creating the crime 2 of injuring or killing specified animals used by law 3 enforcement and emergency agencies; providing elements of 4 the crime; providing penalties; providing definitions; and 5 providing for an effective date. 6 7 Be It Enacted by the Legislature of the State of Wyoming: 8 9 Section 1. W.S. 6-5-211 is created to read: 10 11 6-5-211. Injuring or killing a police dog, fire dog, 12 search and rescue dog or police horse prohibited; 13 penalties. 14 15 (a) Any person who knowingly, willfully and without 16 lawful cause or justification inflicts bodily harm, 17 permanent disability or death upon a police dog, fire dog, Page 1 1 search and rescue dog or police horse is guilty of a felony 2 punishable by imprisonment for not more than three (3) 3 years. 4 5 (b) As used in this section: 6 7 (i) "Police dog" means any dog that is owned, or 8 the service of which is employed, by a law enforcement 9 agency for the principal purpose of aiding in the detection 10 of criminal activity, enforcement of laws or apprehension 11 of offenders; 12 13 (ii) "Police horse" means any horse that is 14 owned, or the service of which is employed, by a law 15 enforcement agency for the principal purpose of aiding in 16 the detection of criminal activity, enforcement of laws or 17 apprehension of offenders; 18 19 (iii) "Fire dog" means any dog that is owned, or 20 the service of which is employed, by a fire department, a 21 special fire district or the state fire marshal for the 22 principal purpose of aiding in the detection of flammable 23 materials or the investigation of fires; 24 Page 2 1 (iv) "Search and rescue dog" means any search 2 and rescue dog that is owned, or the service of which is 3 utilized, by a fire department, a law enforcement agency, a 4 special fire district or the state fire marshal for the 5 principal purpose of aiding in the detection of missing 6 persons, including persons who are lost, who are trapped 7 under debris as a result of a natural, manmade or 8 technological disaster or who are drowning victims. 9 10 Section 2. This act is effective immediately upon 11 completion of all acts necessary for a bill to become law 12 as provided by Article 4, Section 8 of the Wyoming 13 Constitution. 14 15 (END) Page 3 |
